These Terms of Use ("Terms") govern access to and use of the Autentiva platform ("Platform", "Service"), offered by M4B - MOBILE FOR BUSINESS ("Autentiva", "we"). By creating an account, subscribing to a plan or using the Service, you ("Customer") agree to these Terms. If you do not agree, do not use the Platform.
Autentiva is software as a service (SaaS) that generates unique codes per product unit and provides a public validation page, on which the consumer confirms the code's authenticity and the item's provenance — that it came from the Customer (seller) and was not swapped in delivery — and sees the scan history (anti-swapping/anti-cloning signal). We grant the Customer a usage license, personal, non-transferable and non-exclusive, for the term of the subscription — there is no sale or assignment of the software.
The Customer must provide truthful information and keep it up to date. Access credentials are personal and confidential; the Customer is responsible for all activities carried out in their account. Company accounts may have several users with distinct roles, under the responsibility of the company's administrator.
The Service is offered by recurring subscription, according to the contracted plan (monthly or annual) and the usage limits in effect. Payment is processed by partner payment gateways. The subscription renews automatically at the end of each cycle, unless canceled. Any price adjustments will be communicated in advance. In the event of non-payment, access may be suspended after notice.
The Customer agrees not to: (a) use the Service for unlawful purposes or ones that violate third-party rights; (b) attempt to circumvent plan limits, security measures or access control; (c) overload, test vulnerabilities in or interfere with the infrastructure; (d) insert illegal or misleading content. The Customer is solely responsible for the products, brands and data they register on the Platform.
The Platform, its code, design and the "Autentiva" brand belong to Autentiva. The Customer's brand, name and content (products, batches, logos) remain the property of the Customer, who grants Autentiva a license to display them on the validation page and to operate the Service.
We make reasonable efforts to keep the Service available, but it is provided "as is", without any guarantee of uninterrupted or error-free operation. Scheduled or emergency maintenance may occur. Support is provided through the channels indicated on the Platform.
The processing of personal data follows our Privacy Policy, in compliance with Law No. 13,709/2018 (LGPD). With respect to the data the Customer enters and collects through the Platform, the Customer acts as controller and Autentiva as processor, processing it according to the Customer's instructions and the law.
Validation is a signal based on the codes and scans, not an absolute guarantee against swapping, diversion or counterfeiting. The originality and quality of the product are the sole responsibility of the Customer (seller) — Autentiva certifies only the code's authenticity and the item's provenance on delivery. To the maximum extent permitted by law, Autentiva is not liable for indirect damages, lost profits or decisions made based on the Service. Autentiva's total liability is limited to the amount paid by the Customer in the 12 months prior to the event.
Either party may end the subscription at any time, effective at the end of the current cycle. We may suspend or close the account in the event of a breach of these Terms. After closure, the Customer may request the export of their data for a reasonable period; after that, the data may be deleted or anonymized, in accordance with the Privacy Policy and the law.
We may update these Terms periodically. Relevant changes will be communicated; continued use after they take effect implies agreement with the updated version.
These Terms are governed by Brazilian law, including the Internet Civil Framework (Law No. 12,965/2014), the LGPD (Law No. 13,709/2018) and, where applicable, the Consumer Protection Code. The courts of the district of São Paulo/SP are chosen to settle disputes, unless a legal rule provides otherwise.
